Definitions

These terms and conditions apply to all dealings between MONE BROS EXCAVATIONS LTD (“The Company”) and any prospective or actual retail & trade customers of MONE BROS EXCAVATIONS LTD (“you”). References to MONE BROS EXCAVATIONS LTD throughout include our affiliates, agents and sub-contractors where appropriate. By contacting us in connection with products offered for sale or using our website (www.monebrodiy.co.uk) you are deemed to have accepted these terms and conditions in full unless you notify us and we agree to any variation in writing.

All Products

All photographic images are produced in good faith and are displayed as accurately as possible, however they should not be relied upon as a definitive representation of the products and therefore must be used as a guideline only. Due to the nature of Natural Stone, size, colour and texture may vary slightly from the description on our website (www.monebrosdiy.co.uk).

Pricing

Prices are charged at the price shown on the product pages of our website on the date you place the order and are inclusive of VAT where applicable. Errors and omissions are excepted. Prices for bulk purchases are available on written request (sales@monebrosdiy.co.uk).

Delivery

When payment is received by credit or debit card we aim to deliver within 3 working days MONE BROS EXCAVATIONS LTD will contact you to advise the delivery date, our standard delivery is usually within 5 working days (excluding bank holidays) from receipt of payment if all products are in stock. If an item is out of stock we will contact you and inform you of the anticipated supply date and give you an opportunity to cancel your order if you wish. If you cancel in such circumstances we will reimburse you in full using the same payment method by which you paid us. All deliveries will be delivered to the address stated on the order and this will typically be kerbside delivery, depending on the vehicle used. If kerbside delivery is not suitable, goods will be unloaded to the nearest easily accessible and safe access point for the address stated. MONE BROS EXCAVATIONS LTD is not responsible for onwards handling at the property once initial delivery has been completed. All goods should be checked against the order and an acceptance signed. If no signature is obtained, it will be assumed the goods are accepted in full. MONE BROS EXCAVATIONS LTD cannot accept any liability whatsoever for any damage, loss or inconvenience arising out of the transport or carriage of goods where the customer has arranged such transport, or carriage. Any shortages or damaged goods must be notified in writing (by email) sales@monebrosdiy.co.uk within 24 hours of delivery.

Responsibility For Goods

The customer will be responsible for goods from the time when they are delivered. MONE BROS EXCAVATIONS LTD will accept responsibility for goods whilst they are in transit so that, if they are damaged on arrival, MONE BROS EXCAVATIONS LTD will replace free of charge. However this will be the full extent of MONE BROS EXCAVATIONS LTD liability. MONE BROS EXCAVATIONS LTD accepts no liability for suitability of goods ordered by the customer unless the customer specifically states in writing, prior to placing any order, that there are particular requirements for the product.

Custom made Goods

Some of MONE BROS EXCAVATIONS LTD products are made to order, which means that they cannot be exchanged or taken back at all unless the product is actually defective. If this is the case the customer must accept upon ordering that the item is non-returnable. MONE BROS EXCAVATIONS LTD will, wherever possible, provide material samples in advance if required. Custom made orders must have detailed specifications signed and agreed by both the customer and MONE BROS EXCAVATIONS LTD prior to manufacture. Any delay in this is the customer’s responsibility.

Billing and payment terms

Payment is due upon placement of order by means of secure credit card transaction online, by credit card over the telephone or by personal or building society cheque made payable to “MONE BROS EXCAVATIONS LTD”. Please do not send cash.

MONE BROS EXCAVATIONS LTD reserves the right not to release any goods until payment has been received and has cleared. Legal ownership of the goods does not pass from MONE BROS EXCAVATIONS LTD to you until payment in full has been made in clear funds.

Returns policy

MONE BROS EXCAVATIONS LTD goods are not generally sold on a sale and return basis. And therefore do not offer a returns policy unless the products are damaged (see delivery). Your statutory rights remain unaffected.
Ownership and intellectual property
The website content and all written materials, logos, photography, are the intellectual property of MONE BROS EXCAVATIONS LTD.

Health & Safety

MONE BROS EXCAVATIONS LTD intention is to comply at all times with the relevant UK laws including Health and Safety at Work and Environmental Protection acts. It is strongly advised that all suitable precautions are taken off-site, as the majority of the products are heavy in weight. Note that gloves as well as other suitable safety clothing must be worn when handling products supplied by MONE BROS EXCAVATIONS LTD. All customers are referred to health and safety guidelines in connection with goods as no liability shall fall on MONE BROS EXCAVATIONS LTD once the goods have been delivered to the customer.

Amendments

MONE BROS EXCAVATIONS LTD reserves the right to make reasonable amendments to these terms and conditions, such changes shall be deemed to come into effect within 10 days of us notifying you of the changes by email.

Governing law

These terms and conditions are governed by English law, MONE BROS EXCAVATIONS LTD and yourself submit to the exclusive jurisdiction of the courts of England and Wales.
